The Medical Cannabis Act established the Medical Cannabis Advisory Board (MCAB) and the Office of Medical Cannabis (OMC), but they are not the same entity. Medical Cannabis Advisory Board Duties: 

Duties identified in the by-laws for the MCAB include:

Examine and analyze:

• Statutory and regulatory law relating to medical cannabis
• Law and events in other states and the nation with respect to medical cannabis
• Accept and review written comments from individuals and organizations about medical cannabis

Whether to:

• Change the types of medical professionals who can issue certifications
• Change, add, or reduce the types of medical conditions which qualify as serious medical conditions under the act
• Change the form of medical cannabis permitted under the act
• Change, add, or reduce the number of growers, processors, or dispensaries
• How to ensure affordable patient access to medical cannabis
• Permit medical cannabis to be dispensed in dry leaf or plant form, for administration by vaporization (enacted 2020 through legislative rule)

The MCAB has no legislative, administrative, or programmatic authority and is advisory only.

Office of Medical Cannabis Duties: 

The medical cannabis program is implemented and administered by the OMC. The OMC regulates industry and registers patients. All duties can be found in the Medical Cannabis Act (§16A-3-1). 

Some duties established by the act include:

• Issuing permits to medical cannabis organizations and ensure their compliance of the act through inspections and monitoring
• Have regulatory and enforcement authority over the growing, processing, sale, and use of medical cannabis in the state
• Register practitioners and ensure their compliance
• Establish and maintain an electronic database to include activities and information relating to medical cannabis organizations
• Ensure medical cannabis is not diverted or otherwise used unlawfully
• Establish authenticity of ID cards
• Recording recommended forms of medical cannabis
• Establish and maintain public outreach programs about the medical cannabis program
• Restrict advertising and marketing of medical cannabis
• May propose emergency raise as may be necessary to carry out or implement any provisions of the act
